2. GENERAL TERMS OF USE OF THE SITE
2.1. Purpose and scope of the Terms (as defined below)
The sole purpose of the Site is to present the premium retirement homes / residences located in Tunisia and intended for international retirees (the “Residences”).
The Site is a showcase site of an exclusively informational nature for the internet user (“You” and “Your”), allowing You to find out about the Residences.
The reservation of the Residences must be made in accordance with the procedures provided on the website https://www.silver-resorts.com/ and does not fall within the scope of the Site.
The Residences are made available and managed by third-party entities, for which SILVER RESORTS acts exclusively as an intermediary. You may contact SILVER RESORTS to obtain additional information about the Residences and the services offered there in relation to Your situation or that of Your loved ones.

2.2. Site Content
The Site contains items protected by intellectual property rights. Each of the elements making up the Site (e.g., images, logos, illustrations, sounds, texts, graphic elements, publications, software, databases, designs and models, and trademarks, etc.) is the exclusive property of SILVER RESORTS or is licensed to it by the holder of the intellectual property rights (the “Content”).
In view of the foregoing, SILVER RESORTS grants You no other right over the Content than that of consulting it on the Site.
Subject to legal exceptions, any reproduction, downloading, transmission, representation or use of the Content, in any manner whatsoever and in any form whatsoever, is expressly prohibited, under penalty of sanctions provided for both by the French Intellectual Property Code, in particular for copyright infringement (Article L. 331-1 et seq.), trademark rights (Article L. 716-1 et seq.), and by the French Civil Code on civil liability (Article 1241 et seq.).
In this respect, You are not entitled to:
– Copy, modify, create a derivative work from, assemble, decompile (except as provided for by law), sell, assign, sublicense or transfer, in any manner whatsoever, all or part of the Content;
– Access the Site by any means other than the interface provided to You for this purpose, for example by using modified versions of the Site’s source code;

Any hypertext link referring to the Site must be authorised in writing in advance by SILVER RESORTS, which reserves the right to request its removal at any time.
2.3. Your liability when using the Site
You are responsible for (i) setting up the IT and communication resources allowing access to the Site and (ii) the knowledge necessary to use the Internet and access the Site.
You remain responsible for connection and equipment costs related to Internet access and access to the Site, according to the terms set by the Internet service providers and/or electronic communication operators.
You are aware of the risks of diversion and contamination by potential viruses circulating on the Internet or of interruptions in Internet communications.
It is recalled that the fact of (i) fraudulently accessing or remaining in a computer system, (ii) hindering or distorting the operation of such a system or (iii) fraudulently introducing or modifying data in a computer system constitutes offences punishable by criminal sanctions.
You undertake not to communicate to SILVER RESORTS information concerning Your health data or that of Your loved ones, as defined by data protection regulations¹. If necessary, this information will be requested by the entities managing the Residences.
¹ Data relating to the past, present or future physical or mental health of a natural person (including the provision of healthcare services) which reveals information about that person’s state of health. For example, information concerning an illness or certain data from which it is possible to deduce information about a person’s state of health.
2.4. Liability of SILVER RESORTS
SILVER RESORTS endeavours to ensure the accuracy and updating of the information and Content accessible on the Site. However, the Site is provided as is, without any guarantee, in particular of availability or accuracy, in particular with regard to information relating to well-being, medicine and care that may be accessible on the Site.
SILVER RESORTS accepts liability in the event of a breach of the Terms causing You immediate, direct, certain and foreseeable damage. SILVER RESORTS may, however, in no event be held liable in particular for: – indirect damages of any kind whatsoever; – damages that could be suffered to Your technical environment, in particular Your computers, software, network equipment (modems, telephones, etc.) and Your equipment used to access the Site; – any decision arising from Your analysis of information accessible on the Site, whether at the initiative of another user or of SILVER RESORTS, in particular any information relating to well-being and health.
The Site may contain hypertext links referring to third-party websites (the “Third-Party Sites”). SILVER RESORTS controls neither (i) the content of the Third-Party Sites, nor (ii) the accuracy of the information accessible on the Third-Party Sites. Consequently, SILVER RESORTS is in no way liable for damages resulting from Your use of or access to information or content on the Third-Party Sites.
2.5. Amendment of the Terms
SILVER RESORTS reserves the right to modify, at any time and without notice, the Site and the Terms.
You will be informed of these modifications by any means that SILVER RESORTS deems appropriate. We therefore invite You to regularly read the Terms.
If all or part of the new Terms do not suit You, You must stop using the Site.

2.6. Applicable law and competent jurisdictions
The Terms are subject to French law.
For any complaint relating to the use of the Site, please contact SILVER RESORTS at the contact details presented at the top of this document in order to consider an amicable solution.
Failing this, the complaint will be entrusted to the competent Court in accordance with the applicable law.
